The Kids’ Design Contest is a way for your child’s creativity to brighten the spirits of military families facing difficult financial times by designing a comforter pattern.

HOW TO ENTER: Two ways to enter: (a) during the Contest Period (as defined below) go to the Contest link “KIDS DESIGN CONTEST” on Sponsor’s Facebook page at www.facebook.com/companystore (“Website”) and complete and submit an official entry form along with a scanned color image of your child’s original comforter design (“Design”), OR (b) during the Contest Period, on a postcard, print your name, address (including zip code), home telephone number, email address, include your child’s Design on paper not larger than 8.5” x 11” and a signed statement that you are the child’s parent or legal guardian and over the age of 18 in the form of the following: “by signing below, I warrant and represent that I am the parent or legal guardian of the minor who created the submitted design and is named on this Entry and that I am at least 18 year of age or older and have read and agree, on my behalf and the minor’s behalf, to the official rules of this Contest” and mail your entry in a (#10) envelope to KIDS DESIGN CONTEST, Likeable Media, 240 W. 37th Street, 7th Floor, New York, NY 10018 (Design and entry information, together “Entry”). Each mail-in entry must be in a separate postmarked outer envelope. Online entrants must have a valid e-mail address. Automated entries are prohibited, and any use of automated devices will cause disqualification.
LIMIT ONE (1) ENTRY PER PERSON/EMAIL/FACEBOOK ACCOUNT/HOUSEHOLD FOR THE ENTIRE CONTEST PERIOD, REGARDLESS OF ENTRY METHOD. Participants may not enter with multiple email addresses, Facebook accounts, or mailing addresses nor may entrants enter multiple times or under multiple identities. Any participant who attempts to enter with multiple email addresses, Facebook accounts, mailing addresses or under multiple identities or uses any device or artifice to enter multiple times will be disqualified and forfeits any and all prizes won, in Sponsor's discretion. KIDS DESIGN CONTEST ("Contest") entry begins at 12:00:00 a.m. Eastern Daylight Time (“EDT”) on May 25, 2012 and entry ends at 11:59:59 p.m. Eastern Daylight Time “EDT” on June 22, 2012 ("Entry Contest Period"). No facsimiles or mechanically reproduced entries forms accepted. Designs must be hand drawn using paint, pencils, markers, crayons or other drawing instrument, not to exceed 6 colors, no mechanically or system produced designs will be accepted. On-line submissions must be a reproduced image of the original drawing provided in an approved format. Approved formats are .jpg, .gif, or .png. All on-line entries must be entered by 11:59 p.m. EDT on June 22, 2012. Designs submitted by mail must be an original drawing or a color copy of an original drawing. All mail-in entries must be postmarked between May 25, 2012 and June 22, 2012 and must be received no later than June 24, 2012. Entrants acknowledge that entry designs submitted on-line or by mail after June 22, 2012 may have less voting exposure than entries submitted before the Voting Contest Period begins June 23, 2012. Hanover Direct, Inc. ("Sponsor") is not responsible for errors, failures or delays in contest entry form delivery that are human or technical in nature or lost, late, illegible, mutilated, postage-due, incomplete, or misdirected mail/entries. Improper, late, incomplete, mutilated and illegible entries will be disqualified. By entering this Contest, entrants accept and agree to be bound by these rules and the decisions of the judges, which shall be final on all matters. All entries received after valid dates are void and ineligible for prize. All entries & submitted designs become the property of Sponsor and will not be returned; none will be acknowledged or returned. Entrant acknowledges the release of all rights to the design and entrant acknowledges that Sponsor, as owner, may use the designs for general donation or donation as part of the Operation Homefront Initiative that supports military families facing difficult financial times, without any expectation of compensation beyond the prizes outlined in Contest. Proof of submission will not be deemed to be proof of receipt by Sponsor. Those who do not follow all of the instructions, provide the required information in their registration form, or abide by these Official Rules or other instructions of Sponsor may be disqualified.
PRIZES: First Prize (1): One (1) $750.00 The Company Store Gift Card and a TCS Comforter made from their winning design, Approximate Retail Value [“ARV”] $850.00). Second Prize (1): One (1) $500.00 The Company Store Gift Card and a TCS Comforter made from their winning design, [“ARV”] $600.00). Third Prize (1): One (1) $100.00 The Company Store Gift Card and a TCS Comforter made from their winning design, [“ARV”] $200.00). (Total ARV of all prizes is $1,650.00). The First Prize winner will also have the opportunity to have the Sponsor create approximately one thousand (1,000) comforters with the winning Design, no additional compensation will be paid in exchange thereof. The Company Store has teamed up with Operation Homefront to facilitate the distribution of donated comforters to the families of our service men and women around the nation. Thousands of comforters with the winning First Place Design will be donated to Operation Homefront. Total Maximum ARV of all Prizes is $1,650.00. Gift cards subject to all terms, conditions and restrictions as provided on card. The difference in value of prizes as stated herein and value at time of prize notification, if any, will not be awarded. The prize winner (and their parent or legal guardian) must claim their prize by July 11, 2012. Unless specifically stated in the prize description, no substitution of prize offered, no transfer of prize to a third party is permitted and non-cash prizes may not be redeemed for cash value, except Sponsor at its sole discretion may substitute prize of equal or greater value. This is a game of skill. All taxes, and any other fees and expenses not specified, associated with receipt or use of the prize, are the sole responsibility of the winner (and their parent or legal guardian), regardless of whether it, in whole or in part, are used. Winners (and their parent or legal guardian) may be required to provide Sponsor with a valid social security number or tax identification number before the prize will be awarded for tax reporting purposes.
CONTEST: Contest Period begins at 12:00:00 a.m. Eastern Daylight Time (“EDT”) on May 25, 2012 and ends at 11:59:59 p.m. Eastern Daylight Time “EDT” on June 30, 2012 ("Contest Period"). Contest Period includes the Entry Contest Period that begins at 12:00:00 a.m. Eastern Daylight Time (“EDT”) on May 25, 2012 and entry ends at 11:59:59 p.m. Eastern Daylight Time “EDT” on June 22, 2012 ("Entry Contest Period") and the Voting Contest Period that begins 12:00:00 a.m. Eastern Daylight Time (“EDT”) on June 23, 2012 until 11:59:59 p.m. Eastern Daylight Time “EDT” on June 30, 2012 (“Voting Contest Period”). Entrants must submit an original comforter design BY SUBMITTING AN ENTRY, ENTRANT (AND THEIR PARENT OR LEGAL GUARDIAN) ACKNOWLEDGES THAT THE ENTRY MAY BE POSTED ON SPONSOR’S WEBSITE AND/OR FACEBOOK PAGE, IN SPONSOR’S DISCRETION. Submission of an Entry grants Sponsor and its agents an unlimited, worldwide, perpetual, license and right to publish, use, publicly perform the Entry in any way, in any and all media, without limitation, and without consideration to the entrant. One (1) First Prize Winner, One (1) Second Prize Winner, and One (1) Third Prize Winner will be selected as described herein from all eligible Entries submitted. Entries will be posted on Sponsor’s Website as submitted for voting. The Kids Design Contest was created to raise the spirits of military families. Designs should be created with judging criteria ("Judging Criteria") in mind. The judging criteria (“Judging Criteria”) is based on Adherence to the Theme "Creative Comfort for Our Nation’s Heroes". Visitors to the Website will have the opportunity to vote during the period 12:00:00 a.m. Eastern Daylight Time (“EDT”) on June 23, 2012 until 11:59:59 p.m. Eastern Daylight Time “EDT” on June 30, 2012 (“Voting Contest Period”). Limit one (1) vote per person/email address/Facebook account. Any attempt by entrant and/or his/her family/friends to vote more than the number of times authorized herein using multiple names or email address and/or any other fraudulent mechanism, as determined by Sponsor in its sole discretion, shall give Sponsor the right to disqualify Entrant in its reasonable discretion. Winners will be selected by the Designs that obtain the most votes. Entrants acknowledge that entries submitted after the beginning of the Voting Contest Period may have less exposure to public viewing and votes and submit their entries accepting such risk. Entries are encouraged to submit their designs by June 22, 2012 to obtain maximum voting exposure. The Design with the most votes will be the First Prize Winner, subject to verification. The Design with the second highest votes will be the Second Prize Winner, subject to verification. The Design with the third highest votes will be the Third Prize winner, subject to verification. The Company Store will announce the winners and whose decisions are final in all matters relating to this promotion. The votes shown in Sponsor’s Website are not the official vote counts for this Contest and are subject to verification by Sponsor. The Winners (and their parent or legal guardian) will be notified by phone or by mail on or about July 4, 2012 and may be required to execute and return an Affidavit of Eligibility/Liability/Publicity Release within 14 days after notification date or prize may be forfeited. Sponsor is not responsible for any change of email, mailing address and/or telephone number of entrants. Prizes will be awarded to entrant’s parent or legal guardian who must submit all entries, sign and return all required documents. If prize or prize notification is returned as undeliverable or winner is otherwise disqualified, cannot be located or does not respond by deadline date, an alternative winner may be chosen, in Sponsor’s sole discretion and time permitting. In the event that a potential winner is disqualified for any reason, Sponsor reserves the right to award the prize to an alternate entrant who will also be determined by votes casted by visitors to the website, even if the disqualified winner’s name may have been publicly announced.
ENTRY REQUIREMENTS: By submitting an Entry in the Contest, each winner and (and their parent or legal guardian) hereby warrants and represents that the Entry conforms to the Entry Requirements set forth herein. Entry: (a) must comply with these Official Rules and any Terms of Service on the Website; (b) must comply with the posting requirements set forth above and as posted on the Website; (c) cannot be sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, contain nudity or any materially dangerous activity; (d) cannot promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message; (e) cannot be obscene or offensive, endorse any form of hate or hate group; (f) cannot defame, misrepresent or contain disparaging remarks about Sponsor or its products, or other people, products or companies; (g) cannot contain trademarks, logos or trade dress owned by others, or advertise or promote any brand or product of any kind, without permission, or contain any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses; (h) cannot contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media) without permission; Sponsor does not permit the infringement of others’ rights and any use of materials not original to the entrant (except copyrighted materials owned by Sponsor) is grounds for disqualification from the Contest. Do not copy your favorite movie, book or photo or include materials, images, graphics, music or trademarks belonging to any third parties or incorporate the names, voices, likeness or personas of any party other than yourself unless you have obtained all rights necessary to permit you to use same in connection with your Entry and grant the rights herein granted to Sponsor; (i) contain background artwork unless it is an original work of the entrant. Any artwork, murals, etc. that can be seen in Entries must be created solely by the entrant or entrant must be the sole owner of all copyright interests therein; (j) cannot contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, without permission; (k) cannot communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate; and (l) cannot depict, and cannot itself, be in violation of any law. ENTRIES POSTED TO THE WEBSITE WERE NOT EDITED BY SPONSOR AND ARE THE VIEWS/OPINIONS OF THE INDIVIDUAL ENTRANT AND DO NOT REFLECT THE VIEWS OF SPONSOR IN ANY MANNER. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to entrants. Sponsor reserves the right to waive the Contest entry requirements set forth herein in its reasonable discretion. Sponsor reserves the right, in its reasonable discretion, during or upon completion of the Contest Period, to request that any entrant resubmit his or her Entry which fails to comply with the Contest entry requirements prior to any judging or voting period. By submitting an Entry, entrant (and their parent or legal guardian) agree that the submission of the Entry and Design is gratuitous and made without restriction, and will not place Sponsor under any obligation, that Sponsor is free to disclose or otherwise disclose the ideas contained in the Entry on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. Entrant (and their parent or legal guardian) acknowledge that, by acceptance of the Entry submission, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than you. Sponsor reserves the right to, and may or may not, monitor/screen entries prior to posting them to the Website. By entering, you acknowledge that Sponsor has no obligation to use or post any Entry you submit. By submitting a Entry entrant (and their parent or legal guardian if an eligible minor) warrant and represent that it: (a) is your original work, (b) has not been previously published, (c) has not won previous awards, (d) does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; (e) that entrant (and their parent or legal guardian) have obtained permission from a person who's name or likeness is used in the Entry and (f) and that publication of the Entry via various media including Web posting, will not infringe on the rights of any third party rights. Any such entrant will indemnify and hold harmless, Sponsor, Facebook, Inc. and Contest administrators from any claims to the contrary. By accepting a prize, each winner (and winner’s parent or legal guardian if an eligible minor) agrees that its Entry and Design will be deemed a Work Made For Hire under the Copyright laws of the United States, but if it cannot be so deemed, then the winner irrevocably assigns and transfers to Sponsor all of his/her right, title and interest in and to his/her Entry and Design, including all but not limited to all copyright and trademark rights which he or she may have, in the United States and worldwide, therein, for consideration, the receipt and sufficiency of which is hereby acknowledged. Each winner (and their parent or legal guardian) hereby waives in favor of Sponsor, all rights of “Droit Moral” or “Moral Rights of Authors” or any similar rights or principles of law that winner may now or later have to their Entry or Design. Sponsor reserves the right to alter, change or modify the winning Entry or Design, in its sole discretion. Upon request of Sponsor, winner (and their parent or legal guardian) shall execute and deliver such additional instrument of assignment, as may be solely deemed by Sponsor, reasonably necessary to establish the ownership of record of the right, title and interest in and to the Entry and Design and of the copyrights transferred and “Moral Rights of Authors” waived under these Official Rules. Should Sponsor fail to request the said assignment as stated, that shall not be deemed a waiver of Sponsor’s rights and Sponsor may at a later time request the assignment.
ELIGIBILITY: Open to legal residents of the 50 US States and D.C. (Not available to residents of Guam, Puerto Rico, and other US territories). Designs must be created by children age 12 or under as of the date of entry. Entrees must be submitted by the entrant’s parent or legal guardian 18 years of age or older at time of entry. Winners (and their parent or legal guardian) may be required to sign an affidavit to verify legal guardian status and the age of the child creating the Design. Employees, officers and directors (and their immediate family [spouse, parent, child, sibling and their respective spouses] or household members, whether or not related) of Hanover Direct, Inc. and their subsidiaries, affiliates, advertising agencies and promotion agencies are not eligible. Void outside of the 50 US States/D.C., where prohibited, taxed or otherwise restricted by law. Subject to applicable Federal, State and Local laws and regulations. No substitutions permitted. Prize will only be awarded if winner (and their parent or legal guardian) complies with official rules.
GENERAL CONDITIONS: Entry in the Contest constitutes each winner’s (and their parent or legal guardian’s) permission to use winner’s name, photograph and/or voice recordings for publicity purposes, in any and all media, without additional compensation or permission except where prohibited by law. All entrants (and their parents or legal guardians) agree to release and forever discharge Hanover Direct, Inc. and distributors, advertising, promotion and advertising agencies and their affiliates and subsidiaries and the respective employees, directors and officers of the foregoing entities, and Facebook, Inc. ("Contest Parties") from: any and all claims, demands, losses and liabilities, of any nature whatsoever, which they may now or hereafter assert, including but not limited to, claims for injury, death, damages, or illness arising out of or claimed to be arising out of Contest entry, prize acceptance, and/or use or misuse of any prize. Entrants (and their parents or legal guardians) further agree: (a) under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (b) all causes of action arising out of or connected with this contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (c) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. Sponsors and their agents are not responsible for any printing or other errors in contest related material. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Contest and award the prize and select a winner by judging from among all eligible entries received prior to such action, should causes beyond the control of Sponsor corrupt the administration, security, or proper entry of the Contest. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Contest; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten or harass any other person. Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of the entries. With respect to computer entries, sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature. Should multiple users of the same e-mail account enter the Contest and a dispute thereafter arise regarding the identity of the entrant, the authorized account holder of said e-mail account at the time of entry will be considered the entrant. “Authorized account holder” is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Sponsor reserves the right at its sole discretion, to disqualify any individual (and all of his or her entries) who tampers with the entry process.
GOVERNING LAW: By entering, entrants (and their parent or legal guardian) agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of State of New Jersey, without giving effect to any choice of law or conflict of law rules. By entering, entrants (and their parent or legal guardian) consent to the jurisdiction and venue of the federal, state and local courts in Hudson County, New Jersey.
WINNER: To obtain information regarding the winner, Parents or Legal Guardians send a stamped, self-addressed (#10) envelope to: KIDS DESIGN CONTEST WINNER, Likeable Media 240 W. 37th Street, 7th Floor, New York, NY 10018. Winner requests must be received by June 21, 2012.
